01 - Accidents & Damage Reporting
In the event of any accident or damage, the renter must call the insurance company immediately from the time and place of the incident and follow the procedure instructed by them. If the insurance company instructs you to obtain a Police report, you must do so at the nearest Police station. All insurance documents must be handed to the Hertz representative at the time of returning the vehicle for insurance claims processing. It is mandatory that the renter contacts the insurance company in the event of an accident or damage even if an Additional Protection Cover (SCDW) has been purchased.
02 - Damage Liability
The renter will be fully liable for any damage caused to the vehicle during the rental period unless an Additional Protection Cover (SCDW) has been purchased to reduce that liability. Tyre, glass, and theft damage are not covered under any insurance policy and remain exclusively the renter’s responsibility. The renter is obligated to cover all expenses for damage repairs or towing arising from incidents caused by intent or gross negligence - including but not limited to misfuelling, ignoring warning lights, or ignoring suspicious sounds from the vehicle - regardless of any protection cover held.
03 - Security Deposit
The refundable security deposit will be released or refunded upon return of the vehicle at the agreed date and time, provided the vehicle is returned in the same condition as at the time of hire. Any unidentified damage - particularly under-carriage damage - identified at check-in will be notified to the renter within 48 hours and deducted from the deposit. For all rentals exceeding seven (7) days, the security deposit must be paid in cash. Credit cards will not be accepted for deposit on extended rentals.
04 - Return Policy
The renter is obliged to return the vehicle and all associated equipment at the agreed time and place as stated in the Rental Agreement. Early returns will be accepted without any rental refund. Late returns will incur a charge for an additional day. The rental agreement covers only the specified period and can only be extended by written confirmation from the renter. Vehicles returned outside opening hours are considered returned at the next opening hour of the branch. The renter remains liable for any damages or losses that occur until the branch opens, where the vehicle is checked within two hours of the branch’s first opening hour. This also applies to vehicle collections. Returning to a different location may incur additional fees and charges. Please allow at least 20 minutes for the vehicle check-in process and plan your journey to account for travel time, traffic, and flight departure times. 05 - Fuel Policy
The vehicle must be returned with the same fuel level as at the time of collection. 95 Octane unleaded petrol and Super diesel must be used at all times. Using incorrect fuel is classified as gross negligence and the renter will be fully responsible for all resulting repair and towing costs, irrespective of any protection cover held.
06 - Insurance & Roadside Assistance
Full comprehensive vehicle insurance is provided with every rental. Basic roadside assistance is provided at no cost for vehicle issues that are not the renter’s fault. Where the issue is the renter’s fault - including running out of fuel, lost keys, keys locked inside the vehicle, or use of incorrect fuel - the renter is responsible for the full cost of roadside assistance and any parts provided. 07 - Vehicle Care & General Conditions
The vehicle must be handled with care, used on sealed roads only, and returned in the same condition as when handed over. Off-road use is strictly prohibited. If the vehicle exterior or interior is returned in an excessively dirty condition, a cleaning charge of Rs. 7,200 will apply. All vehicles are non-smoking; a charge of Rs. 50,000 will apply if evidence of smoking is found in the vehicle. The renter must not rehire or re-rent the vehicle under any circumstances. Hertz will not be responsible for the loss of any personal belongings left in the vehicle. All vehicles are subject to the relevant tax percentage applicable at the time of vehicle pick-up. The rental agreement shall be interpreted in accordance with Sri Lankan law and under the exclusive jurisdiction of Sri Lankan courts. The renter consents to Hertz collecting, using, and disclosing personal information - including data collected through in-vehicle tracking and the In-Vehicle Monitoring System - in accordance with the Hertz Privacy Policy available at www.hertz.com.au/privacypolicy or from any Hertz rental location.
08 - Traffic Fines & Penalties
The renter is responsible for all fines incurred while the vehicle is in their possession. All fines and dues must be settled with the relevant authorities prior to returning the vehicle to Hertz. Where Hertz facilitates payment on the renter’s behalf, a service fee of USD 25.00 in addition to the amount due will be charged for this service.
09 - Prohibited Use
The following uses are strictly prohibited and will result in the renter bearing full liability for all damages, regardless of any protection cover held: - Causing the vehicle to roll, tip, or fall over, resulting in damage to the side or roof - Driving in National Parks and other forest areas - Driving or parking within 300 metres of a coastal beach area - Driving with a flat tyre or ignoring a warning light - Exceeding posted speed limits - Violating road traffic rules and regulations set by the Department of Motor Traffic, Sri Lanka - Driving under the influence of alcohol, drugs, or any intoxicating substance beyond the applicable legal limit - Driving through beaches, flooded roads, rivers, or other bodies of water - Driving on unsealed, off-road, or prohibited roads (except sealed access roads to recognised accommodation or camping grounds) - Hauling hazardous materials or goods the vehicle was not designed to carry - Fitting unauthorised objects to the interior or exterior of the vehicle - Transporting animals in the vehicle - Sub-letting or re-renting the vehicle to any third party under any circumstances
10 - Governing Law
This rental agreement shall be interpreted in accordance with the laws of Sri Lanka. Any dispute arising from or in connection with this agreement shall fall under the exclusive jurisdiction of the courts of Sri Lanka. Breach of any terms and conditions set out herein, or of regulations established by the Department of Motor Traffic of Sri Lanka, will render the customer fully liable to the full extent of the resulting damage.
